What You Should Do Immediately After A Car Accident

Be Wary of DIY When It Comes To Immigration Matters.

DIY- Do It Yourself sounds good, but when it comes to complex and ever-changing issues like immigration, it can quickly become a nightmare. Oftentimes, your mistake costs more than you hope to save, & the damages are sometimes irreparable.

I have encountered too many nightmarish stories of people without qualified legal advice applying for immigration benefits they are not qualified for & making submissions that jeopardize their case, all in the name of saving cost. A lawyer with nuanced understanding of immigration law can do a holistic analysis of your case & navigate the complex immigration system for you.

Let me itemize some of the risks of DIY for you.

1) You don’t get a refund for filing for the wrong benefit

2) A lawyer is likely to charge more to clean up the mess of your DIY

3) The intended savings of your DIY is not worth the stress & the cost of a redo or appeal

4) Sometimes the risk of DIY is deportation exposure

Don’t spend more than you should in your attempt to spend less.

Do Not Leave The Scene: Leaving the scene of the accident even if you think it is minor may still constitute criminal violation. You will also miss out on the opportunity to preserve evidence of the scene in the form of pictures, videos, & eyewitness account, and make sure the police is furnished with accurate information about how the accident occurred. The last thing you want is to have someone else who is not a neutral party tell the police how the accident happened without your version of how it occurred.

Immediately Call 911: Police presence will facilitate your effort to get important information from others involved in the accident, such as the names and addresses of the driver(s) and passengers. Tell the police how the accident happened to the best of your recollection. Avoid saying and admitting things you are not sure about, because that will likely hinder or complicate your chances of getting paid the amount you deserve for your injury.

Preserve Evidence Of The Scene: You cannot establish your claim and obtain the maximum compensation you deserve without relevant evidence of the accident. The legal system is about evidence and what you can prove, not merely what supposedly happened or what you think happened. You are out of luck if you can’t prove your claim, because the other party will have leverage over you in settlement negotiations and the court can’t help you without relevant evidence to support your claim. So be sure to take pictures, videos, and preserve other evidence in the immediate aftermath of the accident.

Obtain Eyewitness Information: Get contact information of people who saw the accident happen as soon as you can. An eyewitness account that corroborates or confirms your version of how the accident occurred makes your case stronger and increases your chances of obtaining a fair compensation for your injury.

Seek and Accept Medical Treatment: In the heat of the moment of an accident, adrenaline rush can mask your pain and delude you into thinking you are not injured. Do not refuse medical assistance. You should seek help from paramedics who can examine and help transport you to the hospital if they determine your injury warrants serious medical attention. In fact, insurance companies may try to use the fact that you refused medical assistance on the scene as evidence that your injury was not serious and either deny your claim or reduce your compensation.

Call Personal Injury Attorney: You are not required to hire a lawyer, but your interest is better protected if you hire a good one. You should talk to a personal injury lawyer before contacting your insurance company. Insurance companies are in business to make profit and will do what it takes to reduce insurance payouts as much as possible. The insurance companies have skilled claim adjusters and lawyers on their side to save them as much money as possible by offering you low settlement offers. The odds will be against you without the skill and knowledge of a personal injury lawyer who will likely not charge you any fee until your claim is settled or won.
